Immigration Offences. Take Care.

Remember, when you employ new staff, ensure you have sight of original copies of documents that prove the staff member has the right to work in the UK. Passport, Government documents showing the National Insurance number etc. Do not accept copies. During this COVID crisis, there are special rules which enable you to check information in other ways. It is am offence under the Licensing Act 2003, as amended by the Immigration Act 2016, for a premises to employ an individual who does no have the right to work.

The civil immigration penalty can be up to £20,000 per person https://www.gov.uk/penalties-for-employing-illegal-workers.

Also, if you break these rules, you will face a premises licence review before your local licensing authority sub-committee. The ultimate sanction the committee can apply is to revoke your premises licence. Appeals against this decision can be made to the Magistrates’ Court within 21 days.

Remember, check their right to work and keep a copy of the documents.
