A Personal Licence is needed by anyone intending to sell alcohol or authorise the sale of alcohol in any premises, including pubs, off licences, restaurants and hotels but not including private members’ clubs. A Personal Licence is valid indefinitely, unless surrendered, revoked or suspended. A Personal Licence holder is authorised to sell alcohol anywhere in the country, at premises that have a valid premises licence.
Sales of alcohol may not be made under a premises licence unless there is a Designated Premises Supervisor (DPS) in respect of the premises, who must hold a Personal Licence.
Applicants for a Personal Licence must be 18 or over and:
- possess an approved licensing qualification
- must not have had a personal licence forfeited in the past 5 years
- if you have been convicted of a relevant offence under section 4 of the Licensing Act 2003 or a foreign offence your application may be refused
If you have a Personal Licence, you can sell alcohol under any premises licence in England and Wales.
You need a Personal Licence if you want to be a designated premises supervisor (DPS). The DPS will normally be the person who has day-to-day responsibility for running the premises.
There may be a number of Personal Licence holders working at a premises, but there can only be one DPS. The DPS must be appointed by the premises licence holder, who may hold both positions.
Places that sell alcohol need to have both a premises licence and a DPS, if either is not in place, then alcohol cannot be sold. The law around selling alcohol is often quite detailed.
